Terms of Service

Spark helps you show up for the people you love. You own your data. We provide the tools. Don't misuse the service, and we'll keep building it for you. If you subscribe to Spark+, you can cancel anytime. We're here to help, not to trap you.

By creating an account or using Spark, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use Spark. We have written these terms in plain language — please read them.

When you create a Spark account, you're responsible for:

• Being at least 16 years old to use Spark
• Providing accurate information when signing up
• Keeping your login credentials secure — don't share them
• Not sharing your account with others — Spark is for individual use
• All activity that happens under your account

If you suspect unauthorized access to your account, contact us immediately.

Spark is a relationship intelligence companion that helps you stay close to the people you love. The service includes:

• Logging interactions, moments, and reflections about people in your life
• AI-generated conversation sparks, insights, and relationship summaries
• Emotional memory and pattern detection across your relationships
• A full relationship timeline for each person, woven from your moments and shared history
• Search across all your logged memories

We continuously improve Spark. Features may be added, changed, or removed as the product evolves. We'll give reasonable notice before removing features that Spark+ subscribers rely on.

Spark offers two tiers:

• Free tier — unlimited contacts, basic conversation sparks, and emotional memory, with up to 3 Daily Spark slots and 5 photo moments. Free forever.
• Spark+ — $5.99/month or $59.99/year. Includes autopilot nudges, weekly digest, and connection strength, plus advanced AI features and other premium capabilities described in the product.

Prices may change with 30 days' notice to existing subscribers.

Spark+ is billed through Stripe. Here's how it works:

• Renewal — subscriptions renew automatically at the end of each billing period unless you cancel
• Cancellation— you can cancel anytime from your account settings. You'll retain Spark+ access until the end of your current billing period
• Downgrade — when your Spark+ subscription ends, your account reverts to the free tier. Your data is not deleted — it remains accessible within free tier limits
• Payment failure — if your payment fails, we send you an email notification and Stripe retries automatically. Spark+ access is paused if payment ultimately fails until you update your payment method
• Refunds— we generally do not offer refunds for partial billing periods. If you believe you were charged in error, contact us and we'll make it right

You own everything you put into Spark:

• Your contacts, notes, memories, and reflections belong to you — we do not claim ownership of your content
• You grant Spark a limited license to process your content solely to provide the service — including sending it to AI providers for generating insights
• You can request a data export by emailing hello@sparkcircle.app
• You can delete your account instantly from Settings → Delete account, as described in our Privacy Policy

Spark uses AI (powered by Anthropic and OpenAI) to generate conversation starters, insights, nudges, and digests. Important things to understand:

• AI-generated content reflects your inputs, not objective facts — use your own judgment
• AI can make mistakes. Content may occasionally be inaccurate, incomplete, or not appropriate for your specific situation
• You are responsible for how you use AI-generated suggestions in your real-world interactions
• Do not rely on Spark for medical, legal, financial, or crisis support — Spark is a companion tool for everyday relationships, not a professional service

Spark is designed for personal relationship care. Don't use it to:

• Log information about people without a legitimate personal relationship with them
• Stalk, harass, surveil, or monitor someone without their knowledge or consent
• Store content that is illegal, abusive, or violates others' rights
• Reverse-engineer, scrape, or attempt to extract the underlying AI models, algorithms, or features
• Create multiple accounts to circumvent free tier limits
• Share your account credentials with others
• Use Spark for commercial purposes (CRM, sales tracking, etc.) without our written consent
• Use Spark in any way that violates applicable laws

We reserve the right to suspend or terminate accounts that violate these rules.

Spark's name, logo, design, code, and AI systems are owned by Spark and protected by intellectual property laws. Your use of Spark does not grant you any ownership rights over the platform itself. You may not copy, modify, or redistribute any part of Spark without our written permission.

To the fullest extent permitted by law:

• Spark is provided “as is” without warranties of any kind, express or implied
• We make no warranties about the accuracy of AI-generated content
• We do not guarantee that Spark will be uninterrupted or error-free
• We are not liable for any indirect, incidental, or consequential damages arising from your use of Spark
• Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim

Nothing in these terms excludes liability for fraud, or for death or personal injury caused by negligence.

Either party can end this relationship:

• You — can delete your account at any time from Settings → Delete account. Your data is removed immediately and permanently.
• Us — we may suspend or terminate your account if you violate these terms, with notice when reasonably possible

Upon termination, your right to use Spark ends. Sections on liability, intellectual property, and governing law survive termination.

We may update these terms as Spark evolves. When we do:

• We will update the date at the top of this page
• For material changes, we will notify you by email at least 30 days before they take effect
• Continued use of Spark after changes take effect means you accept the updated terms

If you disagree with the changes, you may close your account before they take effect.

These terms are governed by and construed in accordance with the laws of the Province of New Brunswick, Canada, without regard to conflict of law principles. Any disputes will be resolved in the courts of New Brunswick, Canada.
